Terms of Service

1. Agreement to Terms

By accessing or using the SiteSafely platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

SiteSafely is operated by SiteSafely ("we", "us", "our"). These Terms apply to all users of the Service, including site managers, administrators, and workers.

2. Description of Service

SiteSafely is a digital construction site compliance platform that enables site managers to upload safety documents, register workers, collect digital signatures, and manage site inductions.

The Service includes a dashboard for site managers and a worker portal accessible via QR codes placed on construction sites.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration • Maintain the security of your password and account • Notify us immediately of any unauthorised access to your account • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Pricing

Site creation requires a one-off payment processed securely via Stripe. Prices are displayed at the time of purchase and are inclusive of VAT where applicable.

All payments are non-refundable unless otherwise required by law. We reserve the right to change our pricing at any time, but changes will not affect existing purchases.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose • Upload malicious files or content • Attempt to gain unauthorised access to any part of the Service • Interfere with or disrupt the Service or its infrastructure • Impersonate any person or entity • Use the Service to store or transmit content that infringes intellectual property rights

We reserve the right to remove any content that violates these Terms.

6. Data and Content

You retain ownership of all content you upload to the Service, including documents, worker records, and site information.

By uploading content, you grant us a limited licence to store, process, and display that content solely for the purpose of providing the Service to you.

You are responsible for ensuring you have the right to upload any content and that it complies with applicable laws, including data protection legislation.

7. Data Protection

We process personal data in accordance with our Data Protection Policy, available at sitesafely.com/privacy. By using the Service, you acknowledge and agree to the processing of personal data as described in that policy.

Where you upload personal data of workers or other individuals, you are the data controller and are responsible for ensuring you have a lawful basis for processing that data.

8. Availability and Support

We aim to provide a reliable and available Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, during which the Service may be temporarily unavailable.

Support is available via email at support@sitesafely.com. We aim to respond to all enquiries within 24 hours on business days.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service • Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Intellectual Property

The Service, including its design, logos, software, and documentation, is owned by SiteSafely and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

11. Termination

You may close your account at any time through the account settings page. We may suspend or terminate your account if you breach these Terms.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Data Protection Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
